Strict Guidelines for Infomercials

Just because a retailer has an amazing product for a great price, it does not make it easy to sell. Many retailers face legal problems when they put their product on air or online. Retailers can face litigation and even jail time for copyright infringements and false advertising claims.

Many times, retailers will put their product on the air without substantiating claims about the abilities of their products. These are often low budget projects who do not take the time to cover themselves legally. They often times find themselves facing steep fines from the Federal Trade Commission.

Television stations are no longer held liable if they are given the information and sources from the retailer, and they usually require liability insurance as well. However, stations are now keeping a closer eye on products that seem to make outrageous claims and promises.
